Nagpur : The BJP IT Cell member, Sameet Thakkar was arrested by Nagpur police for ‘defamatory’ tweets against chief minister Uddhav Thackeray and his minister son Aaditya in connection with actor Sushant Singh Rajput death case.
He was arrested by the state police just a day after the Bombay high court’s Nagpur bench had rejected his petition for restraining Nagpur police from taking coercive action. Sameet was booked by the local Sitabuldi police for the tweets under sections of 292 (punishment for obscene acts or words in public) and 500 (punishment for defamation) of the Indian Penal Code (IPC) and provisions of Information Technology Act on the complaint of a senior Shiv Sena leader, Nitin Tiwari. He was also booked by the VP Road police in Mumbai under IPC sections for defamation and circulating obscene article, writing, drawing or any other representation and under Information Technology Act. In his complaint with the Mumbai police, Shiv Sena’s legal advisor Dharam Mishra alleged that Thakkar had posted a picture of Uddhav and Aaditya on his Twitter account likening him to a Mughal ruler. Thakkar was also accused of using abusive language against Shiv Sena MP Sanjay Raut. Mishra said Thakkar abused and insulted the Sena leaders in public domain but also made a mockery of the state government.
Thakkar, a resident of Nagpur, who is followed by Prime Minister Narendra Modi on the micro blogging website, was earlier granted interim protection by the Nagpur bench of Bombay high court on August 28. While granting interim protection, the High Court had directed Thakkar to cooperate with the local police with case investigation and report to Sitabuldi police station every day between 6pm and 8pm from October 13 onwards.
However, he filed another petition before the Nagpur bench of the Bombay high court on October 20 and sought to be exempt from reporting to the police state daily. He informed the court that he had filed two more petitions before two High Court benches, including Mumbai, where similar directives were issued. Therefore, it was very difficult for him to come to Nagpur to mark his presence every day. Thakkar had also moved the Supreme Court with his grievance.
However, the Nagpur bench rejected his petition on Thursday and that led to his arrest on Saturday.
His arrest was condemned by a large section of people across the country. “Sameet Thakkar is arrested by Nagpur Police. “Release Sameet Thakkar,” Dinesh Chaudhary, an MLA from UP wrote on Twitter. In a series of tweets, the BJP MLA tweeted against the chief minister Thackeray, his son Aaditya and Mumbai Police Commissioner Param Bir Singh. “Such A Coward Act, Release Sameet Thakkar Now,” he wrote and added “Don’t Worry We Are with you.”
The BJP Haryana’s IT and Social Media Head Arun Yadav wrote, “Shame on You Udhav. Shame on You Parambir Singh. Release Sameet Thakkar (sic).” The Supreme Court lawyer Prashant Patel Umrao also took to Twitter and wrote, “Sameet Thakkar is arrested by Maharashtra Police again just for calling ‘Powerless’ to ‘Papa Penguin’. This is real emergency. They can’t even tolerate criticism and talk about Freedom of Expression. Stand together against illegitimate actions of Maharashtra government. Release Sameet Thakkar.”
